In both scenes it is seen firing, it inaccurately fires six shots when the cylinder only holds five.

The following weapons appear in the film Max Payne:

Beretta 92FS

Max Payne (Mark Wahlberg) uses a Beretta 92FS as his main sidearm in the film.

Beretta 92FS - 9mm.
Max loads up his Beretta 92FS before heading to the train station.
Max chambers his Beretta before entering his partner Det. Balder's (Donal Logue) house. Real cops typically keep their sidearms with a round in the chamber at all times, but it is considered "cooler" for him to rack the action at any given opportunity.
Max searches Balder's house with his Beretta at the ready.
Max's Beretta is knocked away when he is attacked in Balder's house.
Max points his Beretta at Owen Green (Joel Gordon) while using a decent Harries technique to keep the flashlight level.
Max holds his Beretta on Jason Colvin (Chris O'Donnell) while interigating him about his wife's murder.
Max fires his Beretta during the shootout with the SWAT team in the Aesir building.

Taurus Judge

Max Payne (Mark Wahlberg) carries a Taurus 4510 Judge revolver in 410 Gauge and .45 Long Colt as his backup gun in the film. The gun's ultimate power is grossly misinterpreted, since Hollywood sees this as simply a "shotgun revolver", when infact the .45 Long Colt it fires has more effective stopping power than the birdshot rounds it typically fires (based on the shot pattern left by the gun in the film, it is assumed he uses birdshot). In both scenes it is seen firing, it inaccurately fires six shots when the cylinder only holds five.

Max draws his Taurus Judge.
Max fires his Taurus Judge at the thug crawling under the bathroom stalls.
Max blows open the stalls with his Taurus Judge, which wouldn't blast open doors like this in real life. What's interesting is that all the stalls appear to be locked, which was likely done so the explosives used to imitate the shotgun blast could be consistant with each door, and locking them shut makes that easier.

Max lets loose six rounds from a five shot cylinder, while firing through the holster at the attacker in Balder's house.
Max surrenders his Taurus Judge when being held up by Mona Sax (Mila Kunis).
A CGI replicated Taurus Judge is seen firing in the credits, although its actual look is off from the true gun.

Charter Arms Undercover

A Charter Arms Undercover hammerless is seen on the table when Max Payne (Mark Wahlberg) is cleaning and loading his guns. It is assumed he keeps this as an ankle gun, but this is the only instance it is seen in the film.

SIG-Sauer P220 pistol series

At one point in the movie, Max Payne is held at gunpoint with a Sig-Sauer P226R. Later on, during the climax, Mona Sax passes him this gun from the same black man she killed. It sometimes turns into a normal 226 and then, in the end when he kills BB, the slide becomes shorter, suggesting it is the P228R, the P228R is a new gun and has the squared trigger guard unlike the original P228. -The slide appears to be short for a P226R, might be some continuity errors, or it is a P228R. The newer P228R also has a squared trigger guard. -GunnutHk

It's not a P228R. The P228R was introduced after this movie was filmed. It is definitely a P226R. -MT2008

Heckler & Koch MP5KA4

The Heckler & Koch MP5K appears in the movie as the weapon of choice for Mona Sax (Mila Kunis). It's most often seen with a 15-round magazine. During the climax of the movie, Max Payne (Mark Wahlberg) begins his assault with two of these guns. In the ending credits, we see a CGI rendering of this. BB is seen with this gun at the end of the film.
